1. Acceptance of Terms

By accessing or using NextDigital ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree, please do not use the Service.

2. Description of Service

NextDigital is an interactive learning platform that provides browser-based coding workspaces (including VS Code IDE and RStudio), AI-powered chat assistance, structured classes with assignments, certificates, multi-tenant organization management, and related educational tools.

3. User Accounts

3.1 Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.2 Organization Accounts

Organization administrators are responsible for managing their users, groups, and content. They may view user progress, assignment results, and usage analytics within their organization scope.

4. Acceptable Use

You agree not to:

  • Use workspaces for any illegal activity, cryptocurrency mining, or unauthorized network scanning
  • Attempt to gain unauthorized access to other users' accounts, workspaces, or data
  • Abuse AI chat features by generating harmful, misleading, or illegal content
  • Circumvent rate limits, resource quotas, or security measures
  • Share your account credentials or allow unauthorized access
  • Upload malicious code, viruses, or harmful content to workspaces

5. Workspaces & Resources

Workspaces are temporary computing environments provided for learning purposes. We reserve the right to terminate idle workspace sessions to manage resources. Your code and files within workspaces may not persist between sessions unless explicitly saved. Resource limits (CPU, memory, storage) apply per workspace type and plan.

6. AI Assistant

The AI assistant is provided for educational purposes. AI-generated responses may not always be accurate or complete. You should verify AI suggestions before using them in production environments. Conversations are processed by third-party AI providers subject to their respective terms and privacy policies. Usage is subject to rate limits based on your plan.

7. Intellectual Property

7.1 Our Content

The Service, including its design, tutorials, templates, and documentation, is owned by NextDigital and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7.2 Your Content

You retain ownership of code and content you create within workspaces. By using the Service, you grant us a limited license to process your content as necessary to provide the Service (e.g., running your code, sending it to AI providers).

8. Certificates

Certificates are issued upon successful completion of class requirements as determined by the platform. Certificates represent completion of coursework on NextDigital and are not accredited academic credentials. We reserve the right to revoke certificates obtained through fraudulent means.

9. Payment & Plans

Free plans are available with standard rate limits. Paid organization and institution plans are billed as agreed upon in your service agreement. We reserve the right to modify pricing with reasonable notice. Refund policies are outlined in your specific service agreement.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your access to workspaces, conversation history, and certificates may be revoked. We will make reasonable efforts to allow you to export your data before deletion.

11. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, data preservation, or accuracy of AI-generated content. To the maximum extent permitted by law, NextDigital shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the updated terms.
